Consumer Health Data Privacy Policy

This policy explains how BianCuisine handles consumer health data under the Washington My Health My Data Act (RCW 19.373) and Nevada law (NRS 603A.400 to 603A.550). It applies if you live in Washington or Nevada or if we collect your consumer health data there. Our Privacy Policy covers all other personal data.

BianCuisine is provided by Amed Bozo, sole proprietor, Moritzstraße 43, 65185 Wiesbaden, Germany, contact@biancuisine.com.

1. Consumer health data we collect and how we use it

  • Food journal entries: what you eat or drink, the amount, meal and date, calories and nutrients (energy, fat, saturated fat, carbohydrates, sugar, protein, fiber, salt), and where the values came from.
  • Daily goals you set yourself.
  • Meal photos you choose for an estimate, and the estimate of calories, protein, carbohydrates and fat that you review before saving. We do not store the photo.
  • Automatic journal entries (Plus), if you turn them on: planned meals you take part in, and your device time zone.
  • That you use the journal, and the version and time of your journal consent.
  • Dietary labels and excluded allergens in the Discover quick filters you save, because they can point to allergies or intolerances.

We use this data only to provide what you ask for: to keep your private journal, add up your day, show your weekly review, your Today summary and, if you use them, your home-screen widgets, compare entries with your own goals, estimate a meal photo when you start an estimate, and filter recipes. We do not ask for weight, conditions or diagnoses. We do not infer health conditions, and we do not use this data for advertising, profiling or training AI models.

2. Where it comes from

  • From you, when you add entries, goals, photos or filters.
  • From food databases that supply nutrient values for items you add: USDA FoodData Central, Open Food Facts and the German Bundeslebensmittelschlüssel.
  • From our AI service provider, which creates an estimate from a photo you submit.
  • From your household’s meal plan, if you turn on automatic entries.

3. Consumer health data we share

We do not sell consumer health data. We do not share it with third parties or affiliates; we have no affiliates. Categories of third parties with whom we share consumer health data: none.

We disclose consumer health data only to service providers (processors) that act on our written instructions and under contract:

  • Supabase (database and hosting; servers in Frankfurt, Germany): all categories in section 1.
  • OpenAI (photo estimates; may process in the United States): only the meal photo you submit and the resulting estimate. OpenAI may keep requests for up to 30 days to detect abuse.
  • Cloudflare (email forwarding) and Google Workspace (our mailbox): only what you choose to write to us.

4. Your rights

You can:

  • confirm whether we collect, share or sell your consumer health data, and get a copy of it, together with a list of all third parties and affiliates with whom we have shared or sold it and a way to contact them (today this list is empty);
  • withdraw your consent: for the journal and for AI features in the app under More → Privacy & security, and for allergen filters by deleting the filter. We then stop collecting; withdrawing your journal consent deletes your journal;
  • delete your consumer health data: delete entries or filters in the app, withdraw your journal consent, or delete your account under More → Account → Delete account. We delete it from our systems and tell our processors to delete it too. Deletion is complete within 30 days; copies in our database backups are overwritten within 7 days.

5. How to make a request

Use the app as described above, or email contact@biancuisine.com, preferably from the email address of your account. You do not need to create an account to make a request. To protect your data, we confirm requests through your signed-in app or your account’s email address. Requests are free. We answer within 45 days. If we need more time, we tell you why within those 45 days and answer within another 45 days.

6. Appeals

If we decline your request, you can appeal by replying to our answer or by emailing contact@biancuisine.com with the subject “Appeal”. We decide within 45 days and explain our decision in writing. If we deny your appeal, you can contact the Washington State Attorney General at atg.wa.gov/file-complaint or the Nevada Attorney General at ag.nv.gov/Complaints/File_Complaint.

7. Additional information for Nevada

  • How we process: journal data is stored in our database in Frankfurt, Germany, and processed there to show your journal. A meal photo is sent to OpenAI only when you start an estimate and have given your consent; we do not store the photo.
  • Review and changes: you can review and correct your entries and goals in the app at any time.
  • Other companies: no third party collects consumer health data about you over time and across different websites or online services through BianCuisine.
  • Changes to this policy: we tell you about material changes in the app or by email before they take effect. We will not collect new categories of consumer health data or use it for new purposes without first asking for your consent.
